Attorney Li has acted as lead counsel in criminal compliance matters for numerous state-owned enterprises, private enterprises, and foreign-invested companies, as well as their relevant personnel. In particular, she has notable experience advising on and conducting criminal complaints and criminal defence arising from internal investigations and compliance reviews. Representative cases include:
1. Criminal Defence Cases: Attoney Li has represented a senior executive of a Shanghai-based private enterprise in proceedings concerning alleged embezzlement; an employee of a Shanghai cross-border trading company accused of accepting bribes as a non-state functionary; a private entrepreneur in Fujian alleged to have fraudulently obtained bank loans; a senior officer of a Shanghai state-owned enterprise accused of collusive bidding; and members of a Zhejiang-based smuggling group accused of smuggling ordinary goods (cigarettes). These matters were concluded with outcomes satisfactory to the clients.
2. Criminal Complaints Cases: Attoney Li has represented a Shanghai cross-border trading company in criminal complaints against its director for alleged fraud and acceptance of bribes by non-state functionaries. She assisted the police department during the investigation stage through the systematic organisation and analysis of evidential material and continued to act throughout the prosecution and trial stages, resulting in a final decision of conviction.
She has also represented a foreign-invested enterprise in Qingdao in criminal complaints against the general manager of its branch for alleged embezzlement. A formal notice of acceptance of the case was issued by the police department within 28 days. The suspect was subsequently arrested, and the matter has proceeded through prosecution and is currently pending trial.
In addition, Attoney Li has advised and acted for a Beijing-based private entrepreneur in criminal complaints concerning alleged illegal withdrawal of capital contributions and misappropriation of funds by a shareholder.
3. Construction Disputes: In the civil dispute resolution aspect, Attorney Li has extensive experience in complex construction disputes. She acted for the employer in a large-scale construction contract dispute in Ningde, Fujian Province, assisting in the identification of serious construction quality defects and recovering approximately 92% of the compensation previously advanced by the employer to individual purchasers.
Attorney Li also represented an actual constructor as a third-party participant in construction contract proceedings relating to a film and television production base project on Chongming Island, Shanghai. Following evidential submissions made to the court at trial, the claimant discontinued its claims against her client.
In another construction contract dispute, Attorney Li acted for a contractor in Shandong Province. Despite the absence of a final account and valid variation orders, the court ordered the employer to pay approximately 90% of the sum claimed. Such outcome was highly recognised by the client.
